ARTICLE 1 - ABOUT THE SITE www.originoil.ch
The site www.originoil.ch is a site of OriginOil SàRL whose head office is located at 77 chemin des Marais, 1225 Veyrier (Switzerland) and whose founder is Mrs. Anne LASSUS.
The website www.originoil.ch is a site dedicated to the online sale of natural cosmetic products.
ARTICLE 2 - DEFINITIONS
Whenever they are used in the context of these General Conditions of Sale, in the plural or singular, the following terms will have the following meaning:
“The site”: the site www.originoil.ch
“Product(s)”: product(s) offered for sale on the website www.originoil.ch
“We” or the “Seller”: the company OriginOil SàRL
“You”, the “Customer” or “Buyer”: any person placing an order for products on the website www.originoil.ch
ARTICLE 3 - FIELDS OF APPLICATION
These General Conditions of Sale govern all sales of products concluded between the seller and the customer/buyer via the website www.originoil.ch , and will prevail, where applicable, over any other version or any other contradictory document.
These conditions apply to the exclusion of all other conditions, and in particular those applicable to home sales or through other distribution and marketing channels.
No product order can be registered or processed if you have not previously checked the box accepting the General Terms and Conditions. By checking this box, you unreservedly accept these General Terms and Conditions of Sale in their entirety.
They remain accessible at any time on the site. We reserve the right to modify the T&Cs at any time. However, these modifications cannot apply to transactions concluded previously and they will only be binding on you when they have been notified to you, by any means at our convenience, and you have expressly accepted them.
ARTICLE 4 – ORDERS
Territorial limit of sales made on the site www.originoil.ch
OriginOil delivers to Switzerland and France. Delivery is made by parcel by the Swiss Post services for delivery to Switzerland, and by the French Post services for delivery to France.
Placing orders
To order on the site, you must be of legal age and able to enter into contracts. By placing an order on our site, you acknowledge and guarantee that you are of legal age and able to enter into contracts.
The order placed by the Customer constitutes a firm offer to conclude a purchase contract according to the order terms provided by OriginOil . Once validated by the Customer, this order cannot be withdrawn without the acceptance of a formal request for cancellation of the order sent to contact@originoil.ch . OriginOil reserves the right to accept or refuse, without indicating the reasons, any request for cancellation of an order from a Customer. OriginOil communicates its decision of acceptance or refusal by an email sent to the address indicated by the Customer in his order. In the event of cancellation of an order, the Customer's claims are limited exclusively to the full restitution of the advance paid without reimbursement of shipping costs.
In general, you guarantee the accuracy of the information you provide to us during the ordering process and more generally for the purposes of concluding and executing orders.
The ordering terms are specified on the site
The ordering procedure via the website www.originoil.ch takes place in 3 stages:
- the Customer selects the desired goods,
- the Customer indicates the delivery address and selects the desired payment method,
- The Customer sends his order and receives an email confirming receipt of the order without delay.
Product availability
The stock status of the products displayed on www.originoil.ch is purely indicative. In addition, the photos, descriptions and characteristics of the products appearing on www.originoil.ch are not contractual.
Temporary unavailability of a product
In the event that OriginOil is unable to deliver one or more products ordered within 10 working days, OriginOil will inform the customer as soon as possible. The customer will then have the choice:
- To cancel the order for the product(s) that are temporarily unavailable
- To wait for the availability of the missing product(s) (after having been informed by OriginOil of the availability deadline), to receive the entire order
In both cases, the customer must inform OriginOil of his decision by sending an email to contact@originoil.ch , mentioning the order references, within 24 hours following the notice of unavailability of the product(s) ordered. Otherwise, the order can no longer be cancelled.
Permanent unavailability of a product after placing the order
In this case, the customer will be informed by email or telephone of the out-of-stock items. The customer may request the cancellation or exchange of his order by sending an email to contact@originoil.ch and mentioning the number and date of his order as well as his customer number. If no request is made by the customer within 8 days after he has been contacted OriginOil , the order will be shipped with the available items. Only these items will be billed to the Customer.
Modification of the order
Once validated, the order cannot be modified (no deletion of an item is authorized). If and only if the order has not yet been processed, it will be cancelled and a credit will be issued. The Customer will then be able to place a new order in accordance with their wishes. This new order will be subject to new delivery times, as the Seller cannot be held to the deadlines of the cancelled order.
If the Customer wishes to add a product to his order, he must send an email to contact@originoil.ch within 24 hours at the latest after placing his order, mentioning the number, the date of his order, the item(s) he wishes to add to his order as well as his customer number.
ARTICLE 5 - PRICES
Product prices are displayed in Swiss francs (CHF). They include packaging costs, do not include shipping costs and are not subject to VAT.
OriginOil SàRL reserves the right to modify prices at any time but the products will be invoiced on the basis of the rates in force at the time of registration of the orders. They do not include delivery and packaging costs which are invoiced in addition. These amounts are communicated to the Customer at the time of the order.
ARTICLE 6 - PAYMENT CONDITIONS
You can pay for your purchases when registering your order in the following ways:
Bank card: VISA, Mastercard, American Express

In the event of non-compliance with the payment conditions, we reserve the right to suspend or cancel the delivery of current orders made by the Buyer, without prejudice to damages.
ARTICLE 7 – DELIVERIES and Shipping Costs
The Customer pays delivery costs at the rates set by the Swiss Post Office for delivery in Switzerland and at the rates set by the French Post Office for delivery in France.
CH and FR price list
For all orders over 120 CHF, delivery costs are free.
In the case of an unclaimed package, OriginOil cannot be held responsible and the costs of any reshipment of the package are the responsibility of the Customer. Before any reshipment, OriginOil may ask the Customer to pay the related costs in advance by bank transfer to the OriginOil account. If the Customer does not receive any news within one month of sending the transfer request, OriginOil reserves the right to cancel the order.
Delivery area
OriginOil delivers to Switzerland and France.
Delivery times
When you register your order, you will be informed of a delivery time.
We undertake to make our best efforts to deliver the products ordered within the timeframes specified above.
Delivery methods
The shipment of orders is ensured, depending on the option chosen by the Customer:
- By Swiss Post in PostPac Economy or PostPac Priority (surcharge of 1 to 2 CHF depending on the weight of the package) for deliveries in Switzerland
- By French Post in Colissimo for orders to France
Any available item is generally shipped within a maximum of 5 working days (weekends and public holidays are excluded from the time frame).
Delivery is thus deemed to have been made upon the seller's provision of the ordered products or upon delivery of the notice of passage from the La Poste service. In the event of an error in the wording of the recipient's contact details, the Seller cannot be held responsible for the impossibility of delivering the products,
Reception
Upon receipt of the order by the customer, the latter is required to immediately inspect the delivered goods to identify any apparent defects (delivered product not corresponding to the ordered product, packaging defect, possible missing products, etc.). The customer must check the conformity of the delivered goods and immediately notify OriginOil ( contact@originoil.ch ) of any defect. The customer must then provide proof (photo) of the non-conformity of his order.
In the rare case of receiving damaged products, please return the non-compliant merchandise in its original unopened container or packaging. The return of the merchandise must be preceded by the acceptance of a return request submitted by the customer to contact@originoil.ch .
For returned defective products, the customer has the choice between one of the following two options:
- Cash refund by bank transfer, of the value of the defective product(s)
- Replacement of the defective product(s) by standard exchange or by the supply of a product of equivalent value
Shipping costs cannot be refunded under any circumstances.
Deadline for complaints in the event of non-receipt of a package
The customer has 30 days from the date of shipment of his order to notify us of the non-receipt of his package. After this period, no claims will be accepted.
Damaged package
In the event that the package is damaged upon receipt, the customer must not open it and must refuse the package by returning it to the post office on the working day following its delivery. Otherwise, our services will not be able to accept any compensation request.
Packages returned by the service provider responsible for delivery with the words “NPAI” (Does Not Live at the Address Indicated)
For a return of a package in NPAI, after receipt and acceptance of the package by our services, a credit (total of the order, shipping costs deducted) will be made within 48 hours of receipt of the package by the company OriginOil SàRL . The customer will then be able to place his order again.
Returns under the reason “unclaimed”
These are packages that have not been claimed by the customer at the post office within the allotted time.
After receipt and acceptance of the package by our services, a credit (total of the order, shipping costs deducted) will be issued within 48 hours of receipt of the package. The Customer will then be able to place their order again.
ARTICLE 8 - RIGHT OF WITHDRAWAL
In accordance with the legal provisions of the Consumer Code, the customer has a period of 7 days from receipt of the products to exercise his right of withdrawal from OriginOil SàRL without having to provide reasons or pay a penalty. The cost of returning the product(s) will be borne by the customer.
The products must be returned in their original condition and complete (packaging, user guide, etc.) allowing for remarketing. As an exception, unless the parties have agreed otherwise, the right of withdrawal cannot be exercised for personalized products, and products that expire quickly.
ARTICLE 9 - LIABILITY OF THE SELLER
Responsibility
Our products comply with the regulations in force in Switzerland. We cannot be held liable in the event of non-compliance with the legislation of a country other than Switzerland.
The photographs, images and descriptions on the Site are as accurate as possible. However, they are only indicative and not contractual. We cannot therefore be held liable for any differences or modifications between the visual of the product presented on the Site and the product delivered.
The buyer is solely responsible for the choice of products, their storage and their use. As such, it is hereby recalled that it is the buyer's responsibility to be aware, before any order, of the composition of the products and the advice on their use; this information is accessible on the site.
We cannot be held responsible for any poor choice or improper use of the products.
The total or partial inability to use a product due to product incompatibility (for example in the event of an allergy) cannot give rise to any compensation, reimbursement or questioning of the liability of OriginOil . OriginOil is only liable for direct damages that the customer proves are caused by a serious fault of OriginOil . In the event of liability of OriginOil , the latter is limited to the price of the product concerned.
Furthermore, in the event of implementation of our contractual liability, our obligation to provide compensation will in any event be capped at the price of the disputed order paid by the customer (excluding delivery costs).
ARTICLE 10 - DATA PROTECTION
Your personal data relevant to each order are collected, processed, used and stored by us in accordance with the corresponding statutory data protection provisions for the purpose of contract execution.
ARTICLE 11 - APPLICABLE LAW - LANGUAGE - DISPUTES
Transactions concluded through the website www.originoil.ch are subject to Swiss law.
Disputes arising from the formation, execution or resolution of contracts concluded through the Site are submitted to the competent courts under the conditions of common law. However, at the request of the customer or on our proposal, the dispute may be settled by conventional mediation or any alternative dispute resolution method.
In the event of translation of these general terms and conditions of sale into one or more languages other than French, only the French version will be authentic in the event of a dispute.
